LPPortraits Photography Terms & Conditions

It is agreed that the following terms set out the total agreement between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

 Booking Fee/Deposit secures the date, time and services of LPPortraits. It is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer. A cancellation of a wedding less than 12 weeks before the wedding will result in payment in full. Weddings that are postponed to a later date will retain the fee as long as the photographer can reschedule to the new date and time.

Copyright: the 1988 Copyright Act assigns the copyright of photographs to LPPortraits. It is therefore contrary to the Act and illegal to copy photographs, or allow them to be copied by any means photographic or otherwise, by any person or machine other than LPPortraits, unless written consent is given.

Display: LPPortraits may use any images on their website, portfolio, exhibitions or commercially and to generally promote their business, provided that the images used are used lawfully and without damage to the clients.

Licence, Coverage & Reproduction:

  1. LPPortraits shall be granted artistic licence in relation to the poses photographed and the locations used. Due to vagaries of the weather and the willingness of subjects, it may not be possible to capture all the images requested.
  2. Photographs taken during a booking will be at the discretion of The Photographer(s) although every effort will be made to comply with The Client's requirements.
  3. The Photographer shall endeavour to photograph all individuals as requested by The Client at some point during the booking, but no responsibility will be taken by The Photographer(s) in the event of leaving somebody out.
  4. For a church ceremony The Photographer(s) movements are sometimes restricted to the minister in charge. The area the Photographer(s) are given to cover the service may not be ideal but LPPortraits cannot be held responsible for any obstructed views.
  5. Due to a variery of lighting conditions and the limitations of professional digital capture, some colours may alter slighty through a set of photographs. The Photographer(s) will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man made fibers. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.
  6. Although the equipment is checked regularly, The Photographer(s) will not be held responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.

Force Majure or Act of God

  1. The due performance of the contract is subject to alteration or cancellation by the Photographer(s) owing to any cause beyond their control (i.e. sudden death or injury).
  2. The Photographer(s) have other professional photographers who will be contacted by their staff (or family) in the event that they are not able to attend your booking due to the above clause (1)
  3. In the event of cancellation by The Photographer(s) (although all attempts will be made for another photographer to be present (see clause 2, or in the event of total photographic failure (although re-shoots may be arranged if practicable - The Photographer(s)  will not be responsible for costs in order to stage such re-shoots), The Photographer(s) liability shall be limited to a full refund of any deposits and fees paid.

Payments

  1. Wedding Clients : a deposit will be arranged at the time of your booking depending on the package you have chosen. Payment for the photographic coverage is required 2 weeks prior to the wedding and all outstanding monies for goods ordered are payable on delivery.
  2. Other Clients : a sitting fee is payable at the time of the photographic shoot.  Monies due for any orders placed must be paid at the time of ordering.

Placing an Order and Receipt of Goods

  1. Any alteration to orders must be placed within one working day of the order being placed, either by letter (special delivery) or in a telephone conversation. The Photographer(s) will not be held liable for for any costs incurred due to alterations made by The Client after this time.
  2. All wedding orders will take approx. 6-8 weeks to complete. All other orders will take approx 4-6 weeks. If there is a change to this timescale you will be notified at the time of your booking.
  3. The Photographer(s) must be notified either in a telephone conversation or in a letter sent via special delivery within 2 working days of receipt of goods if their is an error, shortage or damage. Mistakes cannot be rectified after this time.
  4. Due to the nature of this product, The Photographer(s) are unable to give exchanges or refunds once goods have been received.

Governing Law

Any contract made between The Photographer(s) and The Client shall in all respects be governed by and construed by in accordance with English Law and the parties hereto submit to jurisdiction of the English courts.

Insurance

The Client is hereby advised to take out an insurance policy to cover any expenses in the event of cancellation
